Police: Man, 76, in hospital after assault for $5

An elderly Tucumcari man is hospitalized after he was beaten and kicked in the head for $5, police said.

Joe Sandoval, 76, was taken to Dan C. Trigg Memorial Hospital for treatment following the attack on Sunday, according to Quay County Magistrate Court documents.

On Tuesday Sandoval was listed in fair condition at Trigg Hospital, a hospital spokesman said.

According to court documents:
Bobby Vandiver, 22, beat and robbed Sandoval in an alley between the 400 block of east Aber and east High streets in Tucumcari.

Several witnesses all positively identified Vandiver as the person who committed the assault and then walked into a home on east High Street.

During questioning Vandiver told police that he was walking down the alley when he saw ‘Joe’ walking in the same alley. He said that he approached Sandoval, asked “Do you hear those dogs barking,” then punched the victim in the head attempting to knock him out.

Vandiver said Sandoval fell down but did not lose consciousness, so he kicked him three times in the head, removed his wallet, took $5 and put the wallet back.

Vandiver said he later removed the shoes and jersey he was wearing at the time of the attack because he thought he had killed Sandoval and did not want to get caught.

Police said $5 was recovered from Vandiver’s front pants’ pocket before he was transported to jail.
