Preliminary hearing set in child abuse case

A preliminary hearing is set for 1:30 p.m. Monday for a Quay County woman charged with child abuse, accused of leaving her 7-month-old baby in a locked car on a hot day.

Kelby Koile, 43, intends to plead not guilty, her attorney Donald Schutte said.

The hearing will be held in Tucumcari Magistrate Court before Judge David Joel Garrett.

Koile was arrested July 23 at Lowe’s Supermarket after Sgt. Rusty Shafer and Cpl. Clay Huffman responded at 7:20 p.m. to reports that a child and a dog had been locked in a passenger vehicle, Tucumcari Police Chief Jason Braziel said.

“This was a mistake and a poor choice of judgment,” Schutte said Tuesday, “but there was no intention to put the child in a position of danger.”

Koile remains free on $10,000 bond.

Koile’s father, Jerry Koile, said on July 29 that the baby is healthy and was returned to the family.
