Gary James Emily was arraigned in Quay County Magistrate Court Tuesday. He entered a plea of not guilty to a felony charge of distribution of marijuana. His bond was set at $50,000. Early Sunday, a state police officer found nearly 38 pounds of marijuana inside the spare tires of a vehicle Emily was driving. Officer David O’Leary, New Mexico State Police, said he pulled Emily over around midnight Saturday near the former Tucumcari Truck Stop on the west side of town. O’Leary received permission from Emily to search Emily’s vehicle. O’Leary said he cut into two of the vehicle’s spare tires and found wrapped marijuana of differing varieties. O’Leary also found a small amount of cocaine in the vehicle, according to court documents. Court officials said no hearings have been set and Emily remains in Quay County Detention Center.
