Assistant district attorney Chavez ousted

Kirk Chavez, assistant deputy district attorney for the Tenth Judicial District, was asked to resign or be fired by District Attorney Tim Rose.

He chose to resign.

Chavez has worked closely with Rose on a number of high-visibility cases in Tenth Judicial District Court since Chavez was hired in April 2013.

In May, Chavez assisted Rose in prosecuting the case against Randall Jones in the murder of Shirley Pacheco on July 9, 2012. The case ended in a first-degree murder conviction.

Chavez had also been making courtroom appearances and presenting arguments with Rose in the Tony Day double-murder case. Day, 15, has been charged with killing his adoptive mother Sue Day and Day’s daughter Sherry Folts in November 2012.

Rose said dismissing Chavez was a “very difficult decision. He’s a good attorney.”

There were issues between Rose and Chavez that Rose said could not be resolved.

Attempts to reach Chavez were not immediately unsuccessful.
