Pharmacist court hearing postponed

A preliminary hearing involving Tucumcari pharmacist Robert McClelland scheduled for Tuesday in Quay County Magistrate Court was postponed indefinitely, a court official said.

Nancy English, McClelland’s attorney, said the hearing was postponed by mutual agreement with prosecutors but offered no additional information.

McClelland is facing four felony charges, three of which involve unlawfully obtaining dangerous drugs and controlled substances and one related to forgery, court records show.

The charges against McClelland involve prescriptions that were alleged to be improperly written for a member of McClelland’s family, according to a “statement of probable cause” signed by Detective Charles Bouyer.

The statement includes evidence gathered by State Drug Investigator Bobby Padilla.

McClelland and English have said the charges stem from a family dispute.

McClelland has pleaded not guilty.

Attempts Tuesday to reach Fourth Judicial District Attorney Richard Flores, who is prosecuting the case, were not successful.
