Wrongful death suit filed in falling death

A Texas woman whose son died after falling from a Tucumcari home’s roof in November has filed a wrongful-death lawsuit against the property owner.

Nancy Crum, who resides in Van Zandt County, Texas, filed the lawsuit Sept. 23 in Tucumcari District Court on behalf of the estate of deceased Quay County resident David Dwayne Miller.

The defendant in the case is Daniel Evans of Tucumcari.

The lawsuit states Evans hired Miller on Nov. 4, 2019, to repair his home’s roof in the 1000 block of South Rock Island Street in Tucumcari.

Miller fell 20 feet from the roof, causing his death. He was 47.

The complaint alleges Evans “was negligent in failing to take reasonable and proper measures” to prevent the accident and was obligated to not permit unsafe conditions there. The lawsuit states Miller was in good health before the accident.

The lawsuit states Crum likely will sustain the loss of companionship, care, support and counsel from her son’s death and has suffered mental anguish and suffering.

Crum, who requested a jury trial, asked for an amount from the court to compensate her for her losses and damages.

Attorney Milad K. Farah of Farah Law Group in El Paso, Texas, filed the lawsuit on Crum’s behalf.
