Man accused of shooting at another

A Tucumcari man remains jailed after he was accused shooting a gun at another man after an argument on a street.

Rodney Lewis Hodges, 46, was charged with receipt, transportation of possession of a firearm by a felon, shooting at or from a motor vehicle (no great bodily harm) and aggravated assault with a deadly weapon. The gun-possession count is a third-degree felony that could lead up to three years in prison or a fine of up to $5,000. The other two counts are fourth-degree felonies.

According to a criminal complaint filed Friday by Tucumcari Police Sgt. Shaun Slate, he received a complaint Jan. 19 from a man who said he was shot at.

Slate said he and officer Santos Saenz spoke to the man and his wife. The woman said she was driving near Fifth Street and Hancock Avenue when another vehicle almost hit her car. She yelled at the driver, and he yelled back. She called her husband, who soon arrived in another vehicle.

The driver left, then returned a short time later and pulled up next to the man on the street. The driver brandished a firearm, pointed it at the man and fired one shot. The bullet missed, and the driver left.

The couple on Jan. 26 identified the shooter, identified as Hodges, in a police photographic lineup. A search warrant also found clothing in Hodges’ vehicle that matched the description of what the couple saw him wearing during the shooting.

Assistant prosecutor Heidi Adams on Friday filed a motion to detain Hodges without bond due to his criminal history dating to 1993 in California and Nevada. She also said Hodges had a history of ignoring court orders, was a danger to the community and was a flight risk.

District Judge Albert Mitchell Jr. is scheduled to hear the pretrial detention motion and hold a preliminary hearing on the case on Feb. 7.
