Logan EMT convicted of indecent assault

A Texas jury required less than an hour to deliver a guilty verdict against a Logan EMT and volunteer firefighter who groped a 17-year-old girl in an Amarillo hotel room in 2021.

Brian Cox of Logan was convicted of indecent assault, a misdemeanor, by a Potter County jury on March 16, according to court records. Cox was 38 at the time of the offense.

Cox was sentenced to 90 days in the Potter County Jail, along with a 365-day suspended sentence and two years of community supervision. He was booked into the jail the next day.

Village of Logan Administrator Rodney Paris said last week the village terminated Cox’s membership as a volunteer EMS and firefighter.

Cox initially took a leave of absence from those positions when the village learned he had a warrant for his arrest.

The victim, along with her mother and father, testified during the two-day trial. The Quay County Sun generally does not identify sexual assault victims.

The father, however, talked to the Sun a few days after the verdict.

“We’re pleased the truth came out in the trial over what he said in the past year and three quarters,” he said.

According to a probable-cause affidavit, the offense occurred on July 12, 2021. It stated Amarillo police were sent to a hotel room where a girl said she was inappropriately touched by a man there. The girl said she traveled from Logan with Cox, and they were sharing a hotel room.

She stated she was on the bed with her phone when Cox touched her inappropriately and made her touch his genitals with her hand.

The affidavit states “she did not want to do these things with Cox but did not stop Cox out of fear as she was only 17 years old and Cox was 38 years old.”

According to the affidavit, Cox told police he was on top of the girl. Cox was allowed to make a phone call to his wife, where an officer heard him tell her he had groped the girl’s breasts.

The victim also filed an order of protection petition against Cox in Quay County District Court, accusing him of sexual assault in Amarillo.

According to a court hearing transcript, Cox said it was “never an assault” but was kissing and touching.

“I never was told to stop,” he said.

District Judge Albert Mitchell Jr. ruled there was an act of sexual assault.

“A 38-year-old with a 17-year-old is a problem,” he said.

Cox was ordered to stay 100 yards away from the girl and 25 yards away from her in public. He was forbidden to have guns during the duration of the order.

The order of protection expired in August 2022.

Cox’s attorney, C. Len Walker, did not return an email requesting comment.
