Woman files lawsuit against Lowe's Market

A Quay County woman filed a lawsuit against Lowe’s Market of Tucumcari after she said she tripped, fell and was injured while shopping in the grocery store nearly three years ago.

Georgia Griego filed the complaint on Aug. 19 in Tucumcari district court against Pay and Save Inc., dba Lowe’s Market. Griego is represented by the Dathan Weems Law Firm of Albuquerque.

According to online court documents, the lawsuit states Griego was shopping in the frozen-foods section of Lowe’s Market on Nov. 2, 2018, and tripped on a section of loose and uneven carpet, causing her to fall forward. She struck her face on a freezer door, causing “severe” injuries to her face, head and body.

Griego claims the market knew or should have known about the defect in the carpet and that it was foreseeable a customer walking through the aisle would not notice it.

She also said she suffered “severe pain of the body and mind,” incurred expenses for medical treatment and remained unable to do her usual household duties.

The complaint requests a judgment from a jury that includes reasonable costs and other relief.

CT Corporation System, a registered agent for Pay and Save based in Espanola, was served with the summons by mail on Aug. 24.

Saige Stewart, an office manager for the Dathan Weems firm representing Griego, stated in an email Friday it would have to speak to Griego before commenting on the matter.

An email last week to Lowe’s corporate office in Texas requesting comment weren’t answered.

Lowe’s Markets, founded in 1964 in Olton, Texas, is based in Littlefield, Texas. It has 140 stores in New Mexico, Texas, Colorado, Arizona and Kansas.
