Local man charged in fatal accident

A Tucumcari man remains in the Quay County Detention Center charged with felony homicide by vehicle for the death of 25-year-old Silvia Chavez-Cruz.

Police said they were already investigating the fatal single vehicle crash when a man who identified himself as David Carlos Guzman, walked into Tucumcari Police headquarters to request an ambulance to respond to an accident on Five Mile Park Road.

Lt. Cleo Baker said when questioned, Guzman admitted to being with Chavez-Cruz at the time of the accident but denied being the driver of the vehicle.

Baker said fingerprint results from the FBI revealed Guzman's true identity as 25 year-old David Urrea. He said through the course of the investigation and eyewitness statements officers determined Urrea was driving the vehicle at the time of the accident.

Police were contacted at 6:46 a.m. and located Chavez-Cruz's body lying next to a Pontiac passenger car on Five Mile Road. Chavez-Cruz was dead at the scene and it is not known if she was ejected or removed from the vehicle, said Lt. Lance Bateman.

Bateman said Urrea was transported to Dan C. Trigg Memorial Hospital for treatment of injuries accompanied by a police escort.

Baker said Urrea was later charged with felony homicide by vehicle, felony causing an accident involving death or personal injury, and three misdemeanor charges of failure to give immediate notice of an accident, failure to render aid and concealing identity.

Urrea is currently being held in QCDC in lieu of $51,000 bond.
